R82-1-304. Background Checks for Resort Licensees

(1) The authority for this rule is Subsection 32B-1-304(7)(a). (2) This rule describes what "engages in the management" of a resort means for purposes of determining which individuals must undergo a background check as part of the application process for a resort license. (3) As used in this section, "engages in the management of a resort licensee" means manages or controls: (a) the daily operations of the business entity of the resort licensee; or (b) the finances of the resort licensee. (4) An individual who engages in the management of a resort licensee shall undergo a background check as part of the application process for obtaining or renewing a resort license.
