R907-65-1. Purpose

The purpose of this rule is to implement a compensation schedule for longitudinal access to the rights-of-way of the interstate system for installation and operation of telecommunications facilities. This Rule establishes the methodology and schedules for charging compensation in accordance with Subsection 72-7-108(3)(b). Subsection 72-7-108(3)(b) requires that the compensation be: fair and reasonable; competitively neutral; nondiscriminatory; open to public inspection; established to promote access by multiple telecommunication facility providers; established for zones of the state, with zones determined based upon factors that include population density, distance, numbers of telecommunication subscribers, and the impact upon private right-of-way users; established to encourage the deployment of digital infrastructure within the state.
