R438-15-16. Retention of Blood Spots

(1) The department retains blood spots for a minimum of 90 days. (2) Before disposal, the department shall de-identify the blood spots. (3)(a) On a form provided by the department, the parent or legal guardian shall indicate: (i) consent to the storage of the specimen for seven years, after which the specimen shall be destroyed; (ii) that the parent or legal guardian does not consent to the storage of the specimen, and the sample will be destroyed after 90 days. (b) If the parent or legal guardian does not return the form or indicate a preference, as described in Subsection (3)(a), the department retains the blood spot for 90 days and destroys the blood spot after 90 days.
