§ 13-1a-106. Authority of director.

10/1/2026The director may: (1) make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to administer the responsibilities of the division; (2) investigate, upon receiving a complaint, the corporation and commercial code filings and compliance governed by a law the division administers and enforces; (3) bring an administrative or civil action in a court with jurisdiction; (4) in accordance with Title 63G, Chapter 4, Administrative Procedures Act: (a) take administrative action against a person that violates a division rule or a law that the division administers, including issuing a cease and desist order; and (b) hold or cause to be held administrative hearings regarding a matter affecting: (i) the division; or (ii) the incorporation or registration activities of a business governed by a law administered by the division; (5) for a purpose described in this chapter or any chapter the division administers: (a) administer an oath; (b) issue a subpoena; (c) compel the attendance of a witness; and (d) compel the production of papers, books, accounts, documents, and evidence; and (6) designate an individual to carry out an action described in Subsection (5).
