A. The department may grant an authorization to construct and test under the general permit for a biomass pilot test facility that meets the applicability criteria in 9VAC5-520-40 and the testing schedule in 9VAC5-520-180 . B. The general permit will be issued in accordance with § 2.2-4006 A 8 of the Administrative Process Act.
