WAC 388-14A-3901. Under what circumstances does DCS review a support order for modification?

(1) The division of child support (DCS) reviews child support orders under WAC 388-14A-3900 when DCS has enough locate information to obtain personal service on both parties to the order; and: (a) The department is paying public assistance or has determined that the children are eligible for medical assistance, and thirty-five months have passed since: (i) DCS last reviewed the order under this section; (ii) The order was last modified; or (iii) The order was entered; or (b) A party to the order, the IV-D agency of a tribe or another state, or the central authority of another country, submits a request for review to DCS and thirty-five months have passed since: (i) DCS or another state or tribe's IV-D agency last reviewed the order under this section; (ii) The order was last modified; or (iii) The order was entered. (2) DCS may refer a request for review to another state or tribe's IV-D agency for action. (3) DCS reviews a child support order for the limited purpose of referring the order to the appropriate tribunal to add abatement language under WAC 388-14A-3940 . A review under this subsection does not impact reviews conducted under subsections (1) or (2) of this section.
