§45-30-10. Enforcement. 10.1. General. The provisions of this rule may be enforced by all of the applicable provisions of W. Va. Code §22-5-1, et seq. 10.2. Violations. Civil penalties shall be recoverable for the violation of any applicable requirement; any permit condition; any fee or filing requirement; any duty to allow or carry out inspections, entry or monitoring activities; any requirement for submission of reports; any rule or order of the Secretary. Such violations shall constitute serious violations for purposes of civil enforcement as contained in W. Va. Code §22-5-6. 10.3. Federal enforcement. For purposes of federal enforcement of any Title V operating permit or provision established under this rule, any reference to the Secretary shall also mean the Administrator of U.S. EPA. 10.4. Tampering prohibited. Pursuant to W. Va. Code §22-5-6, criminal penalties shall be recoverable against any person who knowingly renders inaccurate any required emission or process monitoring device or method.
