§45-3-7. Variance. 7.1. Due to unavoidable malfunctions of equipment, emissions exceeding those provided for in this rule may be permitted by the Director for periods not to exceed two (2) days upon specific application to the Director. Such application shall be made within twenty-four (24) hours of the malfunction or within such other time period as the Director may specify. When parts are not available for repair the Director may grant an extension of time for a period longer than two (2) days, but not to exceed ten (10) days.
