§45-40-40. CAIR NOX Ozone Season Trading Budget. 40.1. The West Virginia CAIR NOX Ozone Season trading budget for allocations of CAIR NOX Ozone Season allowances to applicable electric generating units (EGUs) and non-electric generating units (non-EGUs) for the ozone seasons of 2009 through 2014 and 2015 and thereafter are respectively as follows: CAIR NOX Ozone Season Trading Budget 2009-2014 2015 and thereafter EGUs 26,859 tons 26,525 tons Non-EGUs 2184 tons 2184 tons Total 29,043 tons 28,709 tons 40.2. CAIR NOX Ozone Season units under subsection 4.1 will be subject to the CAIR NOX Ozone Season trading budget for EGUs set forth in subsection 40.1. 40.3. In accordance with 40 CFR §51.123(aa)(2)(iii)(A), CAIR NOX Ozone Season units under subsections 4.3 or 4.4 will be subject to the CAIR NOX Ozone Season trading budget for non-EGUs set forth in subsection 40.1. 40.4. Notwithstanding the budget applicability set forth in subsections 40.1 through 40.3, the CAIR NOX Ozone Season unit under subsection 4.5 shall be allocated CAIR NOX Ozone Season allowances pursuant to section 43.
