§45-40-43. CAIR NOX Ozone Season Allowance Allocation for PPG Unit 002. 43.1. The CAIR NOX Ozone Season unit under subsection 4.5 shall be allocated CAIR NOX Ozone Season allowances as set forth in this section. 43.2. Baseline Heat Input and Baseline NOX Emission Rate. -- Based on the information monitored and reported for the 2002 ozone season, and for purposes of calculation of the CAIR NOX Ozone Season allowance allocation under subsection 43.4, the unit’s baseline heat input shall be 892,161 mmBtu, and the unit’s baseline NOX emission rate shall be 1.04 lb/mmBtu. 43.3. Timing Requirements. 43.3.a. Notwithstanding the timing requirement provisions of section 41, by April 1, 2009, and April 1 of each year thereafter, the Secretary will determine by order the CAIR NOX Ozone Season allowance allocation for the unit in accordance with subsection 43.4 and submit the allocation to the Administrator for recordation in accordance with subdivision 43.3.c. 43.3.b. The Secretary will make available to the public each determination of the CAIR NOX Ozone Season allowance allocation under subdivision 43.3.a and provide an opportunity for submission of objections to the determination. Objections shall be limited to addressing whether the determination is in accordance with subsection 43.4. Based on any such objections, the Secretary will adjust each determination to the extent necessary to ensure that it is in accordance with subsection 43.4. 43.3.c. Notwithstanding the recordation provisions of section 53, the Administrator shall record in the compliance account of the source that includes the unit, the CAIR NOX Ozone Season allowances allocated by the Secretary to the unit under subdivision 43.3.a by April 15, 2009, and by April 15 of each year thereafter. 43.4. CAIR NOX Ozone Season Allowance Allocation. -- For each ozone season beginning in 2009, PPG Unit 002 will be allocated CAIR NOX Ozone Season allowances in accordance with the following procedures: 43.4.a. The heat input (in mmBtu) used for calculating the CAIR NOX Ozone Season allowance allocation will be the lesser of: 43.4.a.1. The unit’s baseline heat input as set forth in subsection 43.2; or 43.4.a.2. The unit’s heat input, as determined in accordance with sections 70 through 75, for the ozone season in the year prior to the year of the ozone season for which the CAIR NOX Ozone Season allowance allocation is being calculated; and 43.4.b. The Secretary will allocate CAIR NOX Ozone Season allowances to the unit in an amount equaling the heat input (in mmBtu) determined under subdivision 43.4.a multiplied by the lesser of the unit’s baseline NOX emission rate (in lb/mmBtu) as set forth in subsection 43.2; or the most stringent state or federal NOX emission limitation applicable to the unit during the ozone season, divided by 2000 lb/ton and rounded to the nearest whole number of CAIR NOX Ozone Season allowances as appropriate.
