§45-5-1. General. 1.1. Scope. -- The purpose of this rule is to prevent and control air pollution from the operation of coal preparation plants, coal handling operations and coal refuse disposal areas. 1.2. Authority. -- W. Va. Code §22-5-1 et seq. 1.3. Filing Date. -- June 2, 2000. 1.4. Effective Date. -- August 31, 2000. 1.5. Repeal of Former Rule. -- This legislative rule repeals and replaces 45CSR1 ATo Prevent and Control Air Pollution from Coal Refuse Disposal Areas@ which was filed on January 1, 1965 and became effective on January 1, 1965. 1.6. Former Rules. -- This legislative rule amends 45CSR5 ATo Prevent and Control Air Pollution from the Operation of Coal Preparation Plants and Coal Handling Operations@ which was filed on April 28, 1995 and became effective May 1, 1995.
