Rescission of All Exemptions Due To Past Non-Competitive Insurance Markets

As a result of past non-competitive insurance markets in Wyoming, the Department previously
provided notifications indicating that certain lines of business were exempt from identified
provisions of the insurance code.
At this time, Wyoming enjoys a robust insurance market and there are no longer any noncompetitive insurance markets in Wyoming. Accordingly, all previously identified exemptions
from provisions of the insurance code as a result of non-competitive insurance markets, including
but not limited to exemptions from the provisions olW.S. 26-11-10a(a)(ii), 26-l l-1O4(a)(iii), 26-
11-105, and 26- 15-i l0(dxiii), are hereby withdrawn, effective immediately. An Order vacating
the previously granted exemptions has been entered contemporaneously with this Bulletin, a copy
of which is available on the Department website. Accordingly, and effective as of the date of
this Bulletin, all insurers who wish to do business or continue to do business in Wyoming
shall comply with all applicable provisions of the Wyoming insurance code and Department
regulations.

OMNIBUS ORDER REGARDING EXEMPTIONS PROVIDED
WHILE INSURANCE MAKET WAS NON-COMPETITIVE
WHEREAS, in or about the 1980's, it was determined by the Insurance Commissioner that certain
areas of the insurance market in Wyoming was not competitive in that it did not have suffrcient admitted
insurers willing to cover certain types of risks, including but not limited to, Lawyers Professional
Liability insurance, school board errors and omissions, real estate agents errors and omissions, insurance
agents errors and omissions, directors and officers errors and omissions, statejudges professional tiability,
psychologists professional liability, psychiatric liability, mental health counselor's professional liability,
social service agency professional liability, pollution liability, and public officials liability policies; and
WHEREAS, in an attempt to improve the availability of insurance, the Insurance Commissioner
entered a variety oforders allowing for exemptions from certain requirements ofthe insurance code for
the noncompetitive lines of insurance; and
WHEREAS, the Orders entered by the Insurance Commissioner included, but may not be limited
to, the order entered April 3, 1985 in docket number 85-21 which allowed exporting certain liability
coverage to surplus lines without compliance with W.S. S$ 26- 11- 104 (a)(ii), W.S. 26-ll-104 (a)(iii) and
26-11-105; and the Order entered September 8, 1986 in docket 85-74 which allowed certain insurance
policies to be used without being filed for approval with the Insurance Department as required by W.S.
$ 26-15-l l0(d)(iii); and
WHEREAS, since 1980's, the insurance market in Wyoming has improved considerably and is
now considered to be a competitive market for all insurance lines, thereby nullifuing the need for the
exemptions afforded by the above-identified orders; and

WHEREAS, it has come to the attention of the current Insurance Commissioner that some
insurers are continuing to rely on the exemptions afforded under the Orders previously entered when the
insurance marke! was noncompelitive.
NOW THEREFORE, IT IS HEREBY ORDERED that all orders previously entered by the
lnsurance Department that allowed exemptions from compliance with the insurance code or any of the
Department's rules or regulations on the basis of a noncompetitive insurance market, including but not
limited to the Orders entered in docket 85-21 and 85-74, are hereby VACATED; and
IT IS FURTHER ORDERED that any insurer who wishes to do or continue to do business in
Wyoming shall follow all applicable provisions oflhe insurance code.
