Ch. 46, § 6. Institutional Level of Care Requirements

(a) An individual with a developmental or intellectual disability diagnosis is not eligible for waiver services pursuant to Section 4 of this Chapter unless the individual qualifies for an intermediate care facility for individuals with an intellectual or developmental disability (ICF/IID) level of care, as measured by the LT-104 assessment. (b) An individual with an acquired brain injury diagnosis is not eligible for waiver services pursuant to Section 4 of this Chapter unless the individual qualifies for a nursing facility level of care, as measured by the LT-101 assessment.
