Hamby, Jr. Pitts and Hamby Attorneys at Law 206 East 3rd Street Sheffield, Alabama 35660 Municipalities - Cherokee Public Funds Town cannot contribute gasoline to rescue squad. Dear Mr. Hamby: The Attorney General received your request for an opinion as to whether the Town of Cherokee may provide gasoline at no charge to the Cherokee Rescue Squad for use in their two vehicles. Your question is to be answered in the negative. It is the opinion of the Attorney General that the above mentioned action on the part of the Town of Cherokee would violate Section 94 of the Constitution of Alabama 1901. This section prohibits a municipality from giving money or a thing of value in aid of a private person, association or corporation. The Rescue Squad, while civic in nature and a non-profit corporation is considered a private association or corporation because it is not an agency or subdivision of the state, county or city.
