Dear Senator Hall: You recently requested that this office render an opinion as to whether or not the Townley Water Authority is subject to the provisions of the Alabama Competitive Bid Law. Code of Alabama 1975, Section 41-16-50, expressly provides that municipal waterworks boards are subject to the competitive bid law. However, purchases of equipment, supplies or materials needed, used and consumed in the normal and routine operation of a waterworks system are exempt from competitive bids provided that no part of the operating expenses of the system have, during the then current fiscal year, been paid from revenues derived from taxes or from appropriations of the state, a county or a municipality.
