# THE ATTORNEY GENERAL STATE OF ALABAMA · MONTGOMERY, ALABAMA 36130 CHARLES A. GRADDICK ATTORNEY GENERAL File # 33 January 23, 1979 79-00037 Mr. Randall Shedd, Chairman Cullman County Commission P. O. Box 698 Cullman, Alabama 35055 Counties - Conflict of Interest - Funeral expense for indigents Dear Mr. Shedd: Your request of January 15, 1979, relating to a county doing business with a firm partially owned by a county tax collector, has been received and researched. It is the opinion of this office that it would be a direct violation of the provisions of Code of Alabama 1975, §§36-10-8, 36-10-14, 36-25-5 for the tax collector of a county to receive any beneficial interest as a result of the payment of funeral expenses by the county for an indi- gent person for the services of a funeral home in which he has a principal interest as in the instant case. Yours very truly, CHARLES A. GRADDICK Attorney General by Randolph G. Lurie Assistant Attorney General RGL:cd
