Dear Mr. Norman:
This letter is written in response to your request for
an opinion regarding Livestock and Poultry Inspectors. Your
specific question was whether Act 150 of 1985 bestows upon
Lifestock and Poultry Inpectors the power to make arrests
for violation of misdemeanor laws of the State of Arkansas
or whether their arrest powers are restricted to violations
of Livestock and Poultry laws and livestock and poultry
commission rules and regulations.
Act 150 of 1985 clarified and expanded the authority of
the Livestock and Poultry Commission relating to the control -
and erratication of disease in livestock and poultry.
Section 5 of this Act authorized the livestock inspectors to
stop vehicles transporting livestock and to check the.
sanitary conditions and the health of the livestock. [In
addition this Section stated:
Such personnel of the commission are further
authorized to make arrests or issue citations to
appear in court to those parties involved in
committing violations of laws and commission
regulations designed to control and eradicate
diseases in livestock and poultry in the State.
This Act goes on to require that these inspectors attend and
successfully complete a curriculum offered by the Arkansas
Law Enforcement Training Academy. .

Livestock inspectors do not have the authority to en-
force or make arrest for violations of the misdemeanor laws
of the State of Arkansas unless they relate specifically to
violations of livestock and poultry laws or violations of
the Livestock and poultry commission rules and regulations.
