Dear Mr. Raff:
This is in response to your request for an opinion on
the following question:
Can the wife of a Quorum Court member be hired by
an elected county official as a deputy clerk
without there being any violation of Arkansas law
and without there being any conflicts of interest?
Ark. Stat. Ann. §17~4208(1) in part, states:
The officer or employee may not use their office,
the influence created by their official position,
of information gained by virtue of their family,
or associates personal economic interest, other
than advancing strictly incidental benefits as may
accrue to any of them from the enactment or
administration of law affecting the public generally.
If the Quorum Court member used#his position, or in-~
fluence in securing his wife's employment as a deputy clerk
then there may be a violation of the aforementioned statute.
However, if his wife secured the position without using any
inside information or influence from her husbands position
then there would not be a violation of the statute.
