STATE OF ARKANSAS OFFICE OF THE ATTORNEY GENERAL JUSTICE BUILDING, LITTLE ROCK 72201 STEVE CLARK March 21, 1985 (501) 371-2007 ATTORNEY GENERAL OPINION NO. 85-90 Honorable Ralph—(Buddy)—Blair,—Jr State Representative 5220 Highland Drive Fort Smith, AR 72930 Re: Teacher Testing Dear Representative Blair: This is in response to your request for an official opinion on whether teachers employed by a private, non- profit corporation which subcontracts with a school district to provide educational services to school age children with developmental disabilities are required to comply with Act 76 of 1983. It is my opinion that a teacher employed by a private, non-profit corporation which subcontracts to a school district would not be required to comply with Act 76. Act 76 covers only certified personnel employed by the public school districts of this State during the 1984-85 school year. The foregoing opinion, which I hereby approve, was prepared by Deputy Attorney General Curtis L. Nebben. Sincerely, /Save lank STEVE CLARK Attorney General SC/CN/pw ce: Daniel B.
