Cal. ELEC § 14284

(a) All ballots shall be marked only with the marking device provided by the elections official or, for vote by mail ballots, recommended by the elections official. (b) If a ballot cannot be tabulated because of the marking device used, it shall be processed as specified in Section 15210.
