4716 ADMINISTRATIVE ─ SUMMARY SUSPENSION, WARNING OR HEARING NOT REQUIRED 4716.1 The Department may summarily suspend a person's license as specified in § 4714 by providing written notice as specified in § 4601 of the summary suspension to the licensee or person in charge, without prior warning, notice of a hearing, or a hearing. 4716.2 The licensee shall have the right to request a hearing within fifteen (15) days of receiving the Department’s summary suspension notice. The Department shall hold a hearing within seventy-two (72) hours of receipt of a timely request, and shall issue a decision within seventy-two (72) hours after the hearing. The request for a hearing shall not act as a stay of the summary suspension action.
