4701. APPLICABILITY

4701 APPLICABILITY 4701.1 These rules apply to the procurement by the Department of goods or services, whether through purchase or lease and whether the goods or services are already in existence or must be developed, including construction and related services which may include but are not limited to: Architectural and engineering services; Construction management; Construction management at risk; Design-bid-build; Design-build; Design-build-finance-operate-maintain; Design-build-operate-maintain; and Operations and maintenance. 4701.2 A procurement of goods or services does not include any goods or services that the Department may acquire as a gift or from a grant, on a pro bono basis, or pursuant to agreements with any agency of the District or federal governments. 4701.3 These rules do not apply to: (a) The purchase or lease of real property by the Department; or (b) The disposition of real or personal property by the Department.
