403. PENTHOUSE AND ROOFTOP STRUCTURE

403 PENTHOUSE AND ROOFTOP STRUCTURE 403.1 In the MU-2/CAP, MU-4/CAP, and MU-4/CAP/CHC zones, the maximum permitted height of a penthouse or rooftop structure, except as limited by Subtitle C ยง 1501 on the roof of a single household dwelling or flat, shall be twelve feet (12 ft.), except fifteen feet (15 ft.) for penthouse mechanical space, and the maximum number of stories within the penthouse or rooftop structure shall be one (1) with a second story permitted for penthouse mechanical space.
