SUPPLEMENTAL BREAST SCREENING EXAMINATIONS AND
DIAGNOSTIC BREAST EXAMINATIONS

This Bulletin reminds all health insurance carriers in Delaware that the Governor signed House
Substitute No. 1 for House Bill No. 60 of the 152nd General Assembly (“the Act”) on July 26, 2023. The
Act added the following sections to the Delaware Code: §§ 3552A and 3370F of Title 18, § 5217 of Title
29, and § 532 of Title 31.
The Act covers all group, blanket, and individual health insurance policies (except specified
accident, specified disease, hospital indemnity, Medicare supplement, long-term care, or other limited
benefit health insurance policies), as well as the State employee healthcare plan and Medicaid.
After December 31, 2024, all policies, contracts, or certificates issued, renewed, modified, altered,
amended, or reissued, must incorporate coverage for diagnostic breast examinations and supplemental
breast screening examinations on terms at least as favorable as those for mammogram screenings.
Accordingly, the Department expects all filings for Plan Year 2025 to include such coverage and requests
that insurers inform consumers of the availability of this coverage.
