In the Matter Of MARKHAM AND CALLOW, INC. and LUMBER & SAW- MILL WORKERS' UNION, LOCAL No. 4, AFFILIATED WITH INTERNA- TIONAL WOODWORKERS OF AMERIOA Case No. R-1376 CERTIFICATION OF REPRESENTATIVES August 29,1939 On July 24, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above- entitled proceeding.' The Direction of Election provided that an election by secret ballot be conducted among the employees of Mark- ham & Callow, Inc., herein called the Company, whose names ap- peared on the Company's pay roll immediately preceding the date of the Direction, including employees who did not work during such pay-roll period because they were ill or on vacation, and employees who were then or had since been temporarily laid off, but excluding supervisory and clerical employees, the civil engineer, and employees who had since quit or had been discharged for cause, to determine whether they desired to be represented for the purposes of collective bargaining by Lumber & Sawmill Workers' Union, Local No. 4, affili- ,ited with International Woodworkers of America, affiliated With the Congress of Industrial Organizations, or by Lumber & Sawmill Workers Union, Local No. 2578, chartered by United Brotherhood of Carpenters & Joiners of America, affiliated with the American Federation of Labor, or by neither. Pursuant to the Direction, an election by secret ballot was con- ducted on August 10, 1939, at Nehalem, Oregon, under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington). On August 14, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, issued an Election Report, copies of which were duly served upon the parties. National Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY CERTIFIED that Lumber & Sawmill Workers' Union, Local No. 2578, chartered by United Brotherhood of Carpenters & Joiners of America, affiliated with the American Federation of Labor, has been designated and selected by a majority of the employees of Markham & Callow, Inc., Nehalem, Oregon, excluding supervisory and clerical employees, and the civil engineer, as their representative for the purposes of collective bargaining and that, pursuant to Sec- tion 9 (a) of the Act, Lumber & Sawmill Workers' Union, Local No. 2578, chartered by United Brotherhood of Carpenters & Joiners of America, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of col- lective bargaining in respect to rates of pay, wages, hours of em- ployment, and. other conditions of employment.
