SUPPLEMENTAL DECISION AND ORDER January 30, 1941 - On October 17, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding., Pursuant- to the Direction of Election, an election by secret ballot was conducted on November 15, 1940, at Estherville, Iowa, under the direction and supervision of the Regional Director for the Eighteenth Region (Minneapolis, Minnesota). On November 18, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued an Election Report, copies of which were duly served upon the International Brotherhood of Team- sters, Chauffeurs, Stablemen and Helpers, Local 844, affiliated with the A. F. of L., herein called the Union, and upon Golden Sun Mill- ing Co., herein called the Company. As to the balloting and its results, the Regional Director reported as follows : Total number eligible --------------- ____------------ ------ 9 Total number of ballots cast-------------------------- 9 Total number of votes counted ------- _---------- --------- 9 Total number of ballots cast for International Brotherhood of Teamsters, Chauffeurs, Stablemen and Helpers, Local 844, affiliated with the A. F. of L___________________________ -3 Total number of ballots cast against above organization------- 6 Total number of blank ballots________________________________ - 0 Total number of void ballots ------------------------------- - 0 Total number of challenged ballots___________________________ 0 On November 22, 1940, the Union filed with the Regional Director a Protest of Election. The Union objected to the election, in sub- stance, on the grounds that the Company had coerced employees in 1 27 N.L. R B. 923. 29 N. L. R. On December 2, 1940, the Regional Director, acting pur- suant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued his Report on .Objections, and on December 31, 1940, his Supplemental Report on Objections, copies ' of which were duly served upon the parties. The Board has considered the Election Report, the Protest of Election filed by the Union, the Report on Objections, and the Supplemental Report on Objections, and finds that.- the protest filed by the UIiion does not present substantial or material issues with respect to the conduct of the ballot or. Election Report. The results of the election show that no collective bargaining rep- resentative has been selected by a majority of the employees in the appropriate 'unit. We shall, therefore, dismiss the Union's petition. ORDER By virtue of Section 9 (c) of the National Lebor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9 of Na- tional Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HERESY ORDERED that the petition for Investigation and Certi- fication of Representatives of employees of Golden Sun' Milling Co., Estherville, Iowa, filed by International Brotherhood of Teamsters,, Chauffeurs,, Stablemen and Helpers, Local 844, affiliated with the A. F. of L., be, and it hereby is, dismissed.
