DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE On September 8, 1941, International Union, United Automobile, Aircraft and Agricultural Implement Workers of America, affiliated with the C. I. 0., herein called the Union, filed With the Regional Director of the Seventh Region (Detroit, Michigan) a petition alleg- ing that a question affecting commerce had arisen concerning the representation of employees of General Motors Corporation, Fisher Body Division, Detroit, Michigan, herein called the Company, en- gaged.in the manufacture of automobiles and automobile parts, and requesting an investigation and certification of representatives pur- suant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act. On November 14, 1941, the National La- bor Relations Board, herein called the Board, acting pursuant to 'Section 9 (c) of the Act and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and authorized the Regional Director to conduct.itand to provide, for an appropriate -hearing upon due notice. On November 3, 1941, the Company, the Union, and a representative of the Board entered into a "STIPULATION FOR CERTIFICA- 37 N. L. R. B.. Pursuant to the stipulation, an election by secret ballot was con- ducted on November 18, 1941, under the direction and supervision of the Regional Director, among all firemen, firemen helpers, and power- house repairmen, excluding the chief engineer, assistant chief en- gineer, shift operating engineers, and all other supervisory employ- ees in the powerhouse of the Fisher Body Division, Plant 10, to determine whether or not they desired to be represented by the Union for the purposes of collective, bargaining. On November 19, 1941, the Regional Director issued and duly served upon the- parties an Election Report on the ballot. No objections to the con- duct of the ballot or the Election Report have been filed by any of the, parties. I. 0______________________________ 0 Upon the basis of the stipulation, the Election Report, and the entire record of the case, the Board makes the following: FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the repre- sentation of employees of General Motors Corporation, Fisher Body Division, Plant 10, Detroit, Michigan, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All firemen, firemen helpers, and powerhouse repairmen ;at Fisher Body Division, Plant 10, excluding the chief engineer, as- sistant chief engineer, shift operating engineers, and all other super- visory employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the- Act. 3. -International Union, United Automobile, Aircraft and Agricul- tural Implement Workers of America, affiliated with the C. I. O., GENERAL MOTORS CORPORATION 799 has been designated and selected by a majority of the employees in the above unit as their representative for the purpose of collective bargaining and is the exclusive representative of all such employees, within the meaning of Section 9 (a) of the National Labor Relations .Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c)' of the National Labor Relations Act, IT IS HEREBY CERTIFIED that International Union, United Auto- mobile, Aircraft and Agricultural Implement Workers of America, affiliated with the C. I. O., has been selected by a majority of all firemen,, firemen helpers, and powerhouse repairmen of General Motors Corporation, Fisher Body Division, Plant 10, Detroit, Mich- igan, excluding the chief engineer,. assistant chief engineer, shift .operating engineers, and all other supervisory employees, as their representative for the purpose of collective bargaining and that pur- suant to Section 9 (a) of the Act, International Union, United Auto- mobile, Aircraft and Agricultural Implement Workers of America, affiliated with the C. I. 0., is the exclusive representative of all such employees for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment. '
