9050.3.1 – Written Notice Contents – Specifications (Rev. 24, Issued: 02-12-16, Effective: 03-14-16, Implementation: 03-14-16) The notice must specify: (See 42 CFR §1004.110(c)) 1. Legal and factual basis for the determination; 2. Sanction to be imposed (e.g., exclusion or monetary penalty); 3. Effective date and, if appropriate, the duration of the exclusion; 4. Appeal rights of the practitioner or other person; 5. Opportunity and process necessary for the practitioner or other person to use alternative notification of patients and others (See 42 CFR §§1004.110(d) and (e)); and 6. In the case of exclusion, the earliest date OIG will accept a request for reinstatement.
