THE FILING OF BRIEFS
On August 17, 2015, Chief Administrative Law Judge Brenda P. Murray issued an Initial
Decision with respect to Jacob Keith Cooper. The Initial Decision stated, among other things,
that “a party may file a petition for review of this Initial Decision within twenty-one days after
service of the Initial Decision.” On October 13, 2015, the Commission issued a Notice that Initial
Decision Has Become Final with respect to the Initial Decision (“Finality Notice”). The Finality
Notice stated that “[t]he time for filing a petition of review of the initial decision in this proceeding
has expired,” and that Jacob Keith Cooper had not filed a petition. Accordingly, the Finality
Notice stated that the Initial Decision had become the final decision of the Commission with
respect to Jacob Keith Cooper. On November 17, 2015, Jacob Keith Cooper filed a petition for
review pursuant to Rule 410(a) of the Commission’s Rules of Practice requesting that the
Commission review the initial decision.

At this time, the Commission requests the views of the parties as to whether Cooper’s
appeal should be dismissed as untimely pursuant to Commission Rule of Practice 410(b).
It is ORDERED that the parties file briefs on this issue, not to exceed five pages, by
December 8, 2015. Responses to the initial briefs, not to exceed three pages, may be filed by
December 15, 2015, and no further briefs may be filed without seeking leave from the
Commission.
