SEC. 5003. RECENT NORTH CAROLINA COAST RED TIDE CONTAMINATION DEFINED. For purposes of this Act, the term “recent North Carolina coast red tide contamination” means contamination of waters under the jurisdiction of the State of North Carolina by unusually high concentrations of the algae known as Ptychodiscus brevis (commonly referred to as “red tide”), with respect to which the Director of the Division of Marine Fisheries of the North Carolina Department of Natural Resources issues a shell fishing closure proclamation on or after November 2, 1987.
