§ 5591. Back pay; individuals reinstated or restored after removal or suspension for cause An individual removed or suspended under section 7501 of this title who, after filing a written answer to the charges under section 7501 of this title or after further appeal to proper authority after receipt of an adverse decision on the answer, is reinstated or restored to duty because the action was unjustified or unwarranted is— (1) entitled to pay, at the rate received on the date of the removal or suspension, for the period for which he did not receive pay with respect to the position from which he was removed or suspended, less the amount he earned through other employment during that period; and (2) deemed to have performed service during that period for all purposes except for the accumulation of leave. Decision on an appeal to proper authority under this section shall be made at the earliest practicable date.
