§ 5592. Back pay; preference eligibles reinstated or restored after removal, suspension, or furlough An individual removed, suspended, or furloughed under section 7512 of this title who, after answering the reasons advanced for the proposed adverse action under section 7512 of this title or after an appeal to the Civil Service Commission under section 7701 of this title, is reinstated or restored to duty because the action was unjustified or unwarranted is— (1) entitled to pay, at the rate received on the date of the removal, suspension, or furlough, for the period for which he did 80 Stat. 497not receive pay with respect to the position from which he was removed, suspended, or furloughed, less the amounts he earned through other employment during that period; and (2) deemed to have performed service during that period for all purposes except for the accumulation of leave.
