APPLICABILITY.

SEC. 5607. APPLICABILITY. The requirements of section 5603 shall not apply to a coastal State if within six months after the date of enactment of this subtitle the Secretary of the Interior certifies that— (1) the State has developed and is implementing a plan that will ensure that there will be pumpout stations and waste reception facilities adequate to meet the needs of recreational vessels in the coastal waters of the State; or (2) existing pumpout stations and waste reception facilities in the coastal waters of the State are adequate to meet those needs.
