EMERGENCY RAIL SERVICES ACT OF 1970 AMENDMENTS.

SEC. 325. EMERGENCY RAIL SERVICES ACT OF 1970 AMENDMENTS. The Emergency Rail Services Act of 1970 is amended— (1) in section 2 (45 U.S.C. 661)— (A) by striking paragraph (2) and inserting in lieu thereof the following: “(2) ‘Board’ means the Surface Transportation Board.”; and (B) in paragraph (3) by striking “common carrier by railroad subject to part I of the Interstate Commerce Act (49 U.S.C. 1–27)” and inserting in lieu thereof “rail carrier subject to part A of subtitle IV of title 49, United States Code”; (2) in section 3— (A) by striking “the provisions of section 5 of the Interstate Commerce Act” in subsection (b)(4) and inserting in lieu thereof “subchapter II of chapter 113 of title 49, United States Code”; and (B) by striking “Commission” each place it appears and inserting in lieu thereof “Board”; and (3) in section 6(a) (45 U.S.C. 665(a)) by striking “Interstate Commerce Commission” and inserting in lieu thereof “Board”.
