SEC. 731. PROHIBITION AGAINST REQUIRING MILITARY RETIREES TO RECEIVE HEALTH CARE SOLELY THROUGH THE DEPARTMENT OF DEFENSE. (a) Prohibition.—Chapter 55 of title 10, United States Code, is amended by inserting after section 1086a the following new section: “§ 1086b. Prohibition against requiring retired members to receive health care solely through the Department of Defense “The Secretary of Defense may not take any action that would require, or have the effect of requiring, a member or former member of the armed forces who is entitled to retired or retainer pay to enroll to receive health care from the Federal Government only through the Department of Defense”. (b) Clerical Amendment.—The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1086a the following new item: “1086b. Prohibition against requiring retired members to receive health care solely through the Department of Defense.”.
