SEC. 1245. ASSISTANT TO THE SECRETARY OF DEFENSE FOR ATOMIC ENERGY (a) Statutory Establishment of Position of Assistant to the Secretary of Defense for Atomic Energy.—(1) Chapter 4 of title 10, United States Code, is amended by adding at the end the following new section: “§ 141. Assistant to the Secretary of Defense for Atomic Energy “(a) There is an Assistant to the Secretary of Defense for Atomic Energy, appointed by the President, by and with the advice and consent of the Senate. “(b) The Assistant to the Secretary shall advise the Secretary of Defense and the Nuclear Weapons Council on nuclear energy and nuclear weapons matters.”. (2) The table of sections at the beginning of such chapter is amended by adding at the end the following new item: “141. Assistant to the Secretary of Defense for Atomic Energy”. (b) Exception to Senate Confirmation.—The person serving as Chairman of the Military Liaison Committee, Department of Defense, under section 27 of the Atomic Energy Act of 1946 (42 U.S.C. 2037) on October 16, 1986, may be appointed as the Assistant to the Secretary of Defense for Atomic Energy under section 141 of title 10, United States Code (as added by subsection (a)), without the advice and consent of the Senate. (c) Amendment to Title 5, United States Code.—Section 5316 of title 5, United States Code, is amended by striking out “Chairman of the Military Liaison Committee to the Atomic Energy Commission, Department of Defense” and inserting in lieu thereof “Assistant to the Secretary of Defense for Atomic Energy, Department of Defense”.
