SEC. 20023. NONDISCRIMINATION. (a) Amendments.—Section 5332 of title 49, United States Code, is amended— (1) in subsection (b)— (A) by striking “creed” and inserting “religion”; and (B) by inserting “disability,” after “sex,”; and (2) in subsection (d)(3), by striking “and” and inserting “or”. (b) Evaluation and Report.— (1) Evaluation.—The Comptroller General of the United States shall evaluate the progress and effectiveness of the Federal Transit Administration in assisting recipients of assistance under chapter 53 of title 49, United States Code, to comply with section 5332(b) of title 49, including— (A) by reviewing discrimination complaints, reports, and other relevant information collected or prepared by the Federal Transit Administration or recipients of assistance from the Federal Transit Administration pursuant to any applicable civil rights statute, regulation, or other requirement; and (B) by reviewing the process that the Federal Transit Administration uses to resolve discrimination complaints filed by members of the public. (2) Report.—Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report concerning the evaluation under paragraph (1) that includes— (A) a description of the ability of the Federal Transit Administration to address discrimination and foster equal opportunities in federally funded public transportation projects, programs, and activities; (B) recommendations for improvements if the Comptroller General determines that improvements are necessary; and (C) information upon which the evaluation under paragraph (1) is based.
