SEC. 5519. [49 U.S.C. 31136 note] OPERATORS OF HI-RAIL VEHICLES. (a) In general.—In the case of a commercial motor vehicle driver subject to the hours of service requirements in part 395 of title 49, Code of Federal Regulations, who is driving a hi-rail vehicle, the maximum on duty time under section 395.3 of such title for such driver shall not include time in transportation to or from a duty assignment if such time in transportation— (1) does not exceed 2 hours per calendar day or a total of 30 hours per calendar month; and (2) is fully and accurately accounted for in records to be maintained by the motor carrier and such records are made available upon request of the Federal Motor Carrier Safety Administration or the Federal Railroad Administration. (b) Hi-Rail Vehicle Defined.—In this section, the term “hi-rail vehicle” means an internal rail flaw detection vehicle equipped with flange hi-rails.
