SEC. 120. UNUSUALLY SENSITIVE AREAS.
(a) Certain Coastal Waters; Coastal Beaches.âSection 19(b) of the PIPES Act of 2016 (49 U.S.C. 60109 note; Public Law 114-183) is amendedâ
(1) by striking âThe Secretaryâ and inserting the following:
â(1) Definitions.âIn this subsection:
â(A) Certain coastal waters.âThe term âcertain coastal watersâ meansâ
â(i) the territorial sea of the United States;
â(ii) the Great Lakes and their connecting waters; and
â(iii) the marine and estuarine waters of the United States up to the head of tidal influence.
â(B) Coastal beach.âThe term âcoastal beachâ means any land between the high- and low-water marks of certain coastal waters.
â(2) Revision.âThe Secretaryâ
; and
(2) in paragraph (2) (as so designated), by striking âmarine coastal watersâ and inserting âcertain coastal watersâ.
(b) Certain Coastal Waters.âSection 60109(b)(2) of title 49, United States Code, is amended by striking âmarine coastal watersâ and inserting âcertain coastal watersâ.
(c) [49 U.S.C. 60109 note] Update to Regulations.âThe Secretary shall complete the revision to regulations required under section 19(b) of the PIPES Act of 2016 (49 U.S.C. 60109 note; Public Law 114-183) (as amended by subsection (a)) by not later than 90 days after the date of enactment of this Act.
(d) Hazardous Liquid Pipeline Facilities Located in Certain Areas.âSection 60109(g) of title 49, United States Code, is amendedâ
(1) in paragraph (1)(B), by inserting â, but not less often than once every 12 monthsâ before the period at the end; and
(2) by adding at the end the following:
â(5) Considerations.âIn carrying out this subsection, each operator shall implement procedures that assess potential impacts by maritime equipment or other vessels, including anchors, anchor chains, or any other attached equipment.â
