SEC. 121. SAFETY-RELATED CONDITION REPORTS. Section 60102(h) of title 49, United States Code, is amended by striking paragraph (2) and inserting the following: โ€œ(2) Submission of report.โ€”As soon as practicable, but not later than 5 business days, after a representative of a person to whom this section applies first establishes that a condition described in paragraph (1) exists, the operator shall submit the report required under that paragraph toโ€” โ€œ(A) the Secretary; โ€œ(B) the appropriate State authority or, where no appropriate State authority exists, to the Governor of a State where the subject of the Safety Related Condition report occurred; and โ€œ(C) the appropriate Tribe where the subject of the Safety Related Condition report occurred. โ€œ(3) Submission of report to other entities.โ€”Upon request, a State authority or a Governor that receives a report submitted under this subsection may submit the report to any relevant emergency response or planning entity, including anyโ€” โ€œ(A) State emergency response commission established pursuant to section 301 of the Emergency Planning and Community Right-To-Know Act of 1986 (42 U.S.C. 11001); โ€œ(B) Tribal emergency response commission or emergency planning committee (as defined in part 355 of title 40, Code of Federal Regulations (or a successor regulation)); โ€œ(C) local emergency planning committee established pursuant to section 301 of the Emergency Planning and Community Right-To-Know Act of 1986 (42 U.S.C. 11001); or โ€œ(D) other public agency responsible for emergency response.โ€ .
