SEC. 3511. EXEMPTION OF CERTAIN STUDENTS FROM REQUIREMENT TO OBTAIN MERCHANT MARINER LICENSE. Section 51309 of title 46, United States Code, is amended— (1) in subsection (a)(2)— (A) by inserting “able or” before “allowed”; (B) by striking “only because of physical disqualification may” and inserting “solely due to a documented medical or psychological condition shall”; and (C) in the paragraph heading, by inserting “or psychological” after “physical”; and (2) by adding at the end the following new subsection: “(d) Definition of Documented Medical or Psychological Condition.—In this section the term ‘documented medical or psychological condition’ means, with respect to an individual, a physical disqualification or psychological condition, including a mental health condition arising from sexual assault or sexual harassment, for which the individual has been treated or is being treated by a medical or psychological provider.” .
