Hayashida, Insurance Commissioner Subject: Offering Transitional Plans with Plans in Compliance with the Affordable Care Act The Commissioner does not intend to take action under the insurance laws of the State of Hawaii, to prohibit entities currently participating in plans issued under the Centers for Medicare and Medicaid Services extension of transitional policy for non-grandfathered health insurance coverage (“Transitional Plans”), commonly referred to as “grandmothered” plans, from continuing to participate in those Transitional plans based on those entities offering an Affordable Care Act option alongside a Transitional Plan.
