ITO INSURANCE COMMISSIONER MEMORANDUM 2012-4E TO: All Insurers Eligible to Write Nonadmitted Insurance in Hawaii All Licensed Surplus Lines Brokers All Insureds Independently Procuring Nonadmitted Insurance FROM: Gordoni.Ito ~~0 RE: Insurance Commissioner Withdrawal from the Nonadmitted Insurance Multi-State Agreement ("NIMA") and NIMA, Inc. On June 7, 2012, the State of Hawaii Insurance Division provided notice to Director Merle D. Scheiber, Vice Chair ofNIMA, Inc., of Hawaii's withdrawal from NIMA and NIMA, Inc. All multi-state surplus lines taxes were to be collected and distributed to participating states by a Clearinghouse created by NIMA. Differences between Hawaii's surplus lines law and NIMA, Inc.'s operating procedures could not be resolved to allow Hawaii to continue to participate in NIMA, hence our withdrawal. Pursuant to the NIMA agreement, the withdrawal is effective sixty (60) days from June 7, 2012, however, NIMA has authorized Hawaii to not participate in multi-state surplus lines tax filing or tax allocation when the NIMA Clearinghouse becomes operational on July 1, 2012. Therefore, all quarterly surplus lines taxes for policies (both multi-state and single state) where Hawaii is deemed the home state should be filed with the Hawaii Insurance Division at the following address: State of Hawaii Insurance Division, Department of Commerce and Consumer Affairs 335 Merchant Street, Room 213 Honolulu, Hawaii 96813.
