HAR §11-37-11. Distributor and retailer registration

(a) Beginning January 1, 2026, no manufactured hemp product distributor or manufactured hemp product retailer shall sell or offer for sale manufactured hemp products without a certificate of registration. All distributors and retailers of manufactured hemp products shall obtain a certificate of registration by submitting an application in accordance with subsection (b) and a $50 application fee and online application processing fee to the department, except that: (1) Hemp processors with a valid permit issued pursuant to subchapter 5 shall be issued certificates of registration and added to the registry by the department for the sale and distribution of manufactured hemp products as indicated on the processor permit application. A hemp processor may apply for registration of additional retail and distribution locations in accordance with this section, including paying the $50 application fee and online application processing fee. (2) The distribution and retail of manufactured tinctures and hemp products that are topically applied is exempt from the requirements of this section and section 11-37-12, provided that the manufactured hemp products and their sale comply with all other applicable requirements of this chapter. (3) Carriers or entities that ship goods shall not be subject to this subchapter by reason 37-24 3622_ §11-37-11 of their receipt, carriage, holding, shipping, or delivery of manufactured hemp products in the usual course of business as carriers or entities that ship goods unless the carrier or entity sells or offers for sale manufactured hemp products. (b) The application for registration shall be on the form prescribed by the department and shall include: (1) Individual representative information: (i) First and last name; (ii) Title; (iii) Email address; and (iv) Mailing address (individual representative); (2) Name of business; (3) Hawaii business registration document issued by the state; (4) Hawaii tax ID; (5) Trade name, if applicable; (6) Trade name registration document issued by the state, if applicable; (7) For an online retailer or distributor, website; (8) For a retail or distribution location, physical street address; (9) Mailing address; (10) Phone number; (11) Email; (12) List of manufactured hemp products to be sold; (13) Required attestations, including an attestation of compliance with section 11-37-16; (14) Evidence that the person applying for registration is the property owner or has received permission from property owner to operate as a manufactured hemp product distributor or retailer at the location listed on the application; (15) For temporary events: (A) Temporary event name; 37-25 862 §11-37-11 (B) Temporary event start and end dates; (C) Location of temporary event; and (16) Any other information requested by the department. (c) An application that fails to contain all required information or does not include the application fee and online application processing fee shall be deemed incomplete. Any incomplete application shall be denied. (d) For a temporary event, the application shall be submitted no less than seven days before the event start date. (e) Upon receiving a complete application that meets all requirements, the department shall issue a certificate of registration valid for five years, except: (1) For temporary event registrations, the registration shall be valid for the duration of the event. (2) For hemp processor registrations completed as part of the hemp processor permit application, the certificate of registration shall be issued with the same expiration date as the permit. (f) Except for hemp processor registrations completed as part of the hemp processor permit application, a certificate of registration shall be renewed by submitting an application in accordance with subsection (b) and a $50 renewal application fee and an online application processing fee to the department. (g) The department shall include registrants with a valid certificate of registration on its registry list until: (1) The certificate of registration expires or is suspended or revoked in accordance with section 11-37-13; or (2) For hemp processor registrations completed as part of the hemp processor permit application, the hemp processor's permit: (A) Expires; 37-26 3 6 2 2 §11-37-13 (B) Is revoked in accordance with section 11-37-48; or (C) Is surrendered in accordance with section 11-37-49. (h) Distributors and retailers of manufactured hemp products shall be responsible for complying with all other applicable statutes, regulations, codes, and agreements, including zoning and lease agreements. The department does not review or approve compliance with other legal or contractual requirements as part of the registration process.
