(a) A retailer of manufactured hemp products shall conduct due diligence reviews of its suppliers to ensure that the supplying distributor holds a valid certificate of registration, except when purchasing: (1) Tinctures; or (2) Manufactured hemp products intended for topical application to the skin or hair. 37-28 3622 §11-37-15 (b) A retailer or distributor of manufactured hemp products shall conduct due diligence reviews of its suppliers to ensure that any product that it sells in the State is compliant with this chapter and chapter 328G, HRS. (c) A retailer of manufactured hemp products shall maintain records of all purchases of manufactured hemp products. Records shall be kept for three years after the purchase and shall include: (1) A complete description of the product purchased; (2) The quantity purchased; (3) The name and address of the seller; (4) The date of the transaction; and (5) A demonstration of compliance with subsection (a) and (b). (d) A distributor of manufactured hemp products shall maintain records of all purchases and sales of manufactured hemp products. Records shall be kept for three years after the sale or purchase and shall include: (1) A complete description of the product sold; (2) The quantity sold; (3) The name and address of the purchaser; (4) The date of the transaction; and (5) A demonstration of compliance with subsection (b).
