HAR §11-37-13. Suspension or revocation of a certificate of registration

(a) The department may suspend or revoke any person's certificate of registration for violation of any applicable provision of this chapter, chapter 328G, HRS, or other applicable statutes, regulations, codes, and agreements, including zoning and lease agreements.
(b) If the department suspends or revokes a person's certificate of registration, the department shall notify the person in writing of the reason for the suspension or revocation.

(c) A person whose certificate of registration is suspended or revoked may appeal the decision by submitting a written request for a hearing to the department not later than twenty days from the date of the department's notice of suspension or revocation.
(d) Upon receipt of a timely request for a hearing, the department will provide a hearing in accordance with chapter 91, HRS.
(e) Upon suspension or revocation of a certificate of registration pursuant to subsection (a), the distributor or retailer shall immediately:
(1) Cease selling manufactured hemp products;
(2) Dispose of all manufactured hemp products that exceed the total tetrahydrocannabinol content limits per serving or per package or container specified in section 11-37-5(a) and (b), and all other hemp-derived products that do not meet the manufactured hemp product requirements in subchapters 1 to 4; and
(3) Submit to the department evidence of compliance with paragraph (2).
(f) Following the suspension or revocation of a certificate of registration, the department may reinstate a suspended certificate of registration or allow a distributor or retailer to apply for a new certificate of registration after the distributor or retailer has corrected the violations.
