Enforcement Remedy Of Summary Suspension And Transfer Of Resident

The Department may summarily suspend the provider’s certificate and transfer the resident when convinced by a preponderance of the evidence that the resident’s health and safety are in immediate jeopardy. In such a transfer, the provider must: (3-28-23) 01. Return Resident's Possessions. Comply with Subsection 261.03 of these rules; and (3-28-23) 02. Refund Prepaid Charges. Refund to the resident a prorated amount restoring prepaid charges for room, board, and care for the month within fourteen (14) calendar days of the Department’s notice of summary suspension.
