Section 104.230Â
Dismissal of Petition
A petition is
subject to dismissal if the Board determines that:
a)Â Â Â Â Â Â Â Â The
petition requests relief that the Board is not empowered to grant;
b)Â Â Â Â Â Â Â Â The petition fails to
comply with the requirements of 35 Ill. Adm. Code 101.Subpart C and Sections
104.202, 104.204, 104.206 and 104.208;
c)Â Â Â Â Â Â Â Â The petitioner fails to
timely comply with any order issued by the Board or the hearing officer,
including an order requiring additional information under Section 104.228; or
d)Â Â Â Â Â Â Â Â The petitioner is not
subject to the rule or regulation, requirement, or order of the Board at issue.
