Calculation of Decision Deadline

Section 104.232  Calculation of Decision Deadline a)         Under Section 38(a) of the Act, the Board will render its final decision on the petition within 120 days after the date of filing of the petition or the receipt of a request for hearing under Section 37(a) of the Act, whichever is later, except: 1)         When the petitioner waives its right to a decision within the prescribed decision period in accordance with 35 Ill. Adm. Code 101.Subpart C; 2)         When the petitioner files an amended petition for variance under this Subpart, the decision period recommences from the date of filing of the amended petition; or 3)         When a hearing is canceled under 35 Ill. Adm. Code 101.510. b)         Time will be computed in accordance with 35 Ill. Adm. Code 101.Subpart C.
