Applicability
Section 215.960Â
Applicability
a)Â Â Â Â Â Â Â Â The requirements of this Subpart apply to the following
counties:Â Cook, DuPage, Kane, Lake, Macoupin, Madison, McHenry, Monroe, St.
Clair and Will.
b)Â Â Â Â Â Â Â Â The requirements of this Subpart apply to a plant's
miscellaneous organic chemical manufacturing process emission sources which are
not regulated by Subpart B, E, F, N, P, Q, R, S, U, V, X, Y, or Z if the plant
is subject to this Subpart. A plant is subject to this Subpart if it contains
process emission sources, not regulated by Subpart B, E, F, N, P, Q, R, S, U,
V, X, Y, or Z, which as a group would emit 100 tons or more per year of
volatile organic material if no air pollution control equipment were used.
c)Â Â Â Â Â Â Â Â If a plant ceases to fulfill the criteria of subsection (b),
the requirements of this Subpart shall continue to apply to a miscellaneous
organic chemical manufacturing process emission source which was subject to and
met the control requirements of Section 215.966.
d)Â Â Â Â Â Â Â Â No limits under this Subpart apply to:
1)Â Â Â Â Â Â Â Â Emission sources with emissions of volatile organic material
to the atmosphere less than or equal to 1.0 ton per year if the total emissions
from those sources not complying with Section 215.966 do not exceed 5.0 tons
per year; and
2)Â Â Â Â Â Â Â Â Emission sources whose emissions of volatile organic material
are subject to limits in 35 Ill. Adm. Code 230 or 35 Ill. Adm. Code 231; or the
Lowest Achievable Emission Rate, under 35 Ill. Adm. Code 203; or Best Available
Control Technology, under a permit issued under Section 9.1(d) of the Act or under
Section 9.4 of the Act.
e)Â Â Â Â Â Â Â Â For the purposes of this Subpart, an emission source shall be
considered regulated by a Subpart if it is subject to the limits of that
Subpart or it would be subject to the limits of that Subpart if the emission
sources, emitting VOM, had sufficient size, throughput or emissions, or if the
emission source did not meet a specific exemption contained in that Subpart.
f)Â Â Â Â Â Â Â Â For the purposes of this Subpart, uncontrolled volatile
organic material emissions are the emissions of volatile organic material that
would result if no air pollution control equipment were used.
